  1. A California lawyer proposed a ballot initiative to legalize the execution of gay and lesbian people in the state.
  2. The measure isn't expected to end up on the ballot, since it's clearly unconstitutional, but it's drawing attention to California's bizarre ballot initiative process.
  3. California's attorney general is likely required by law to clear the initiative. But the state's Supreme Court is likely to step in and stop the measure, particularly if the proposal gets enough signatures to qualify for the ballot.

The measure would authorize the killing of gay and lesbian Californians

Under the measure, the LGBT flag could be seen as illegal advocacy.

Orange County attorney Matt McLaughlin paid the $200 filing fee on February 26 to submit the "Sodomite Suppression Act" to voters on November 2016.

The proposal has no chance of becoming law, since it's unconstitutional and would most likely never get approval from California voters, but it's drawn national attention because its provisions are so abhorrent and extreme.

As the San Francisco Chronicle and Sacramento Bee reported, the proposal would require the execution of anyone who touches a person of the same sex for sexual gratification by "bullets to the head or by any other convenient method." It declares that it's "better that offenders should die rather than that all of us should be killed by God's just wrath." Private citizens would be allowed to step in to act as executioners if the state didn't within a year, meaning that the murder of gay and lesbian people would effectively be legalized.

The measure would also make it illegal, with the threat of a $1 million fine, up to 10 years in prison, and permanent expulsion from the state, to advocate for gay rights to an audience that includes minors. And it would require posting the measure's language prominently in public school classrooms.

The initiative specifies that its constitutionality could only be decided by a California Supreme Court that doesn't include LGBT justices and their supporters, but that portion would only be true if the measure passed.

The proposal very likely won't pass, but it's drawing attention to California's initiative process

In California, ballot initiative sponsors pay a $200 filing fee for their measure, the attorney general gives it a title and summary, supporters collect more than 365,000 signatures, and, if all that's successful, California votes on it.

California Attorney General Kamala Harris, who's considering a Senate run in 2016, appears to have no options for blocking the measure. Legal experts told the San Francisco Chronicle and Sacramento Bee that the attorney general is required by law to provide a title and summary for proposed ballot measures once someone pays the $200 filing fee.

This set-up, legal experts said, prevents elected attorneys general from interfering with citizen-proposed ballot initiatives that they politically disagree with. Instead, more politically impartial judges are able to decide the constitutionality of proposed measures.

The California Supreme Court could and is expected to step in to block the proposal if it gets too far in the process. The measure violates constitutional due process protections for people who commit private, consensual sexual activity, and it tries to unconstitutionally limit people's free speech rights with multiple provisions that would try to stop certain forms of LGBT advocacy.

In the meantime, the measure has drawn criticism from advocates who say the filing fee for ballot initiatives, which hasn't been increased since 1943, is too low. "Increasing the fee, even to $500 or $1,000, would help ensure that those who put initiatives into circulation are sincere in their efforts," Kim Alexander, president and founder of the California Voter Foundation, told the Sacramento Bee.

The newspaper reported a sharp rise in proposed ballot initiatives in recent years: from 47 in the 1960s to nearly 650 in the 2000s.

The measure could get its sponsor disbarred

State legislators are trying to get the California Bar to look into McLaughlin's involvement with the initiative and consider disbarring him.

Lawyers in the state are supposed to demonstrate "good moral character," including respect for the rights of others, California State Sen. Ricardo Lara (D-Bell Gardens, Los Angeles County) told the San Francisco Chronicle.

This isn't the first time McLaughlin proposed a ballot initiative. The Chronicle reported that he suggested adding the King James Bible as a literature textbook in California public schools in 2004 because of its "rich use of the English language." His latest proposal, needless to say, ventures into far uglier territory.

At first I've thought I haven't really understand and my English is too bad to translate it for me correct. I couldn't believe that a person with a real brain can ask for such a crime without getting collared at once. And this brute is an lawyer?

I really must ask why we are indignant at all the Arab states or ISIS if we have our own ISIS like this lawyer and sure he will have supporters. And we are writing 2015 and not 1415.

I do not know the laws of the US, but in my country, a nation among the most homophobic of the world, if someone proposes a similar thing is indicted and prosecuted.

Actually, I don't see why they would. A ballot measure cannot be unconstitutional because it is not (yet) a law.

We tried to get Proposition 8 (making same-sex marriage illegal in California) taken off the ballot arguing that it violated the U.S. Constitution. The State Supreme court refused to take the case saying that until it passed, became law and someone brought a case there was nothing for anyone to sue over. Essentially, they said go away and come back if it passes.

Which it did in 2008. So we sued and won (three times).

Los Angeles (AFP) - California announced legal action to suppress a "reprehensible" ballot initiative to outlaw homosexuality -- on pain of execution -- in the famously liberal US state.

The proposal -- unlikely to advance, as it requires over 360,000 signatures to proceed -- was submitted by lawyer Matthew McLaughlin to the California Attorney General's office late last month.

The "Sodomite Suppression Act" ballot proposes that gay people "be put to death by bullets to the head or by any other convenient method."

But the state's Attorney General Kamala Harris said she was taking legal action to allow the state to effectively sideline the proposal.

"This proposal not only threatens public safety, it is patently unconstitutional, utterly reprehensible, and has no place in a civil society," she said in a statement.

"Today, I am filing an action for declaratory relief with the court seeking judicial authorization for relief from the duty to prepare and issue the title and summary for the 'Sodomite Suppression Act.'

She added: "If the court does not grant this relief, my office will be forced to issue a title and summary for a proposal that seeks to legalize discrimination and vigilantism."

The proposed initiative declares: "The abominable crime against nature known as buggery, called also sodomy, is a monstrous evil that Almighty God, giver of freedom and liberty, commands us to suppress on pain of our utter destruction even as he overthrew Sodom and Gomorrha.

"Seeing that it is better that offenders should die rather than that all of us should be killed by God's just wrath against us... the people of California wisely command, in the fear of God, that any person who willingly touches another person of the same gender for purposes of sexual gratification be put to death by bullets to the head or by any other convenient method," it reads.

California, like other US states, regularly holds elections on ballot initiatives -- effectively referendums on proposed issues which must gather a minimum number of signatures to get on the ballot.

LGBT civil rights group Equality California welcomed Harris's move, but said it showed the need to reform the state's ballot processes.

“This proposed ballot initiative is grossly out of step with the attitudes and beliefs of the people of California," said the group's executive director Rick Zbur in a statement.

"While we do not believe that this offensive measure will have sufficient support to qualify for the ballot, it points to the need to review and reform the ballot initiative process.

He added: "We look forward to working with Attorney General Harris, policymakers, and members of the legislature to review .. implement reforms to assure that public resources are not wasted on measures that clearly violate the law or Californians’ constitutional rights."

I don't agree he should be arrested, but I do agree that his license to practice law should be revoked for attempting to do something so unconstitutional, and so immoral.

This is a post that I put on my Tumblr page in response to this article:

So, I was reading a story that both pissed me off about the subject, but also pissed me off about the reaction. The title of the story is: California Forced To Allow Signatures For Appalling ‘Shoot The Gays’ Ballot Initiative.

First off, the guy who wrote up this bill is a total ass. You realize that he is promoting the murder of gay people, or the expulsion from California, or ten years in prison for just being gay? That is just totally ridiculous. One of these days people will just start to figure out that being gay is not a choice. Having gay sex in porn to make money, that is a choice. Hustling sex to make a living, that is a choice. But being gay itself is not a choice. I certainly hope that this does not get enough signatures to get on the ballot.

Second, though I think the petition is totally absurd, I think that the guy has every right to try to put this one the ballot. This is the democratic way that we do things in this country. Crazy or not. Do I think that he should go to jail for advocating murder? That is a hard one because we have other crimes that we advocate the murder of those people for. Right now I can only think of one, murder. So yea, I think it would be a little harsh to sentence someone to die just for being gay. I do know that there are countries where, yes, you can be executed for having gay sex. Hopefully, someday soon, that will not be the case.

What if I wanted to pay the $200 so I could put a petition up to make it illegal to serve peanut butter and jelly sandwiches? And what if I wanted the punishment to be expulsion to North Dakota to a fenced in work camp north of Fargo? Sure, there is absolutely no way on the PLANET that it would get on the ballot, but it is my right to try. (Sorry to everyone in N.D.) Then everyone can laugh me right out of the state.

Do I think that this guy has the right to do what he did? YES. Do I think he should be punished for what he wants the punishment to be? NO. At least not until we do away with capital punishment in general. Which wont happen any time soon since Utah just put the firing squad option back on their lineup.

If we do not let this guy try then we are trampling on the first amendment rights that we take to heart and want to preserve. Yes I do think that this guy is a nut job and the petition is absurd. But I do believe that this is a part of free speech. And if it were to make it on the ballot, I would go vote no on it as is MY right to do. I will defend the right of free speech to even the groups that I hate the most. It is the backbone of the United States of America. Yes, I do HATE what this guy is trying to do, but it is his right to try.

I hope you can all see where I am coming from.

I think it would be headline fodder for weeks. I think there would be demands for investigations by the Justice Department. I think there would be claims that this incited the inevitable demonstrations that turned into riots, looting, arson etc.

This is not a big deal for America. It's okay for someone to call for a 'final solution' of the Gay problem. Proposing a referendum like this is legal so there will be no consequences for this guy. He knew that. He gets to call for the murder and/or imprisonment of Gays in so many words without risking anything.

It sends a message that it's okay to contemplate murder as long as the targets are Gay and not another minority. What if this proposal plants a seed in some troubled individual or a hate groups collective mind that turns into action? After all a lawyer and elected official proposed it in as a ballot initiative.

I know that is an extremely improbable scenario but stranger things have happened. Fact is more unbelievable than fiction many times.

This guy needs to be taken out behind the barn and given a good ass whipping by his daddy but he probably learned his hate and prejudices from his daddy so that is improbable too, lol

Good times in the good ol' U.S. of A.
